I wasaided i n my review by various documents contained i n PFCManning's detainee f i l e , ' reference ( a ) , Chief Warrant O f f i c e r 4James Averhart's response t o PFC Bradley Manning's request f o rredress, and enclosure (2).'2. FINDINGS. I n accordance w i t h paragraph 2 of enclosure ( 1 ) ,the f o l l o w i n g f i n d i n g s are submitted.a. Question 2.a.: Are the conditions of PFC Manning'sconfinement authorized by a p p l i c a b l e Navy and Marine Corpsregulations?Answer: Yes, reference (a) authorizes the currentconditions o f PFC Manning's confinement.b. Question 2.b.: Did Chief Warrant O f f i c e r 4 Averhart abusehis d i s c r e t i o n i n c l a s s i f y i n g PFC Manning as a maximum custodydetainee?Answer: No, reference (a) r e s t r i c t s the B r i g Commander t oassigning a custody c l a s s i f i c a t i o n o f e i t h e r Maximum Custodyor Medium Custody-In t o a l l p r e - t r i a l detainees. I n t h i s case, the CO had a v a r i e t y of supplementalinformation provided to him and his s t a f f from Manning'scommand and previous confinement f a c i l i t y that they alsocons idered.c. Question 2.c.: Did Chief Warrant Officer 4 Averhart abuseh i s discretion i n placing PFC Manning i n a prevention ofi n j u r y status?Answer: No, reference (a) authorizes the Brig Commanderor, i n h i s absence, the duty b r i g supervisor to placeconfinees i n a prevention of i n j u r y status i f they display,admit to, or i f the s t a f f i s made aware of by other means arequirement for additional supervision and a t t e n t i o n . This i snormally due t o r i s k of suicide, violence, personalitydisorders, behavior abnormalities, or other questionablecharacter t r a i t s .'d. Question 2.d.: Did Chief Warrant O f f i c e r 4 Averhart abusehis discretion i n placing PFC Manning i n a suicide r i s kstatus?Answer: No, reference (a) authorizes the b r i g s t a f f toplace individuals i n a "suicide r i s k " status who havethreatened suicide, made a suicidal gesture, or have a h i s t o r yof suicide attempts. Documents contained i n PFC Manning'sdetainee f i l e support a determination that a t specific timeshe should have been considered a threat t o himself. I twarrants mentioning however, that on two occasions, 6 August2010 and 18 January 2011, a medical o f f i c e r determined thatsuicide r i s k status was no longer warranted and the b r i g s t a f fdid not immediately take PFC Manning o f f the suicide r i s kstatus. PFC Manning was taken o f f suicide r i s k status on 11August 2010, following the medical o f f i c e r ' s recommendation of6 August 2010. PFC Manning was taken o f f suicide r i s k statuson 21 January 2011, following the medical o f f i c e r ' srecommendation of 18 January 2 011. Paragraph 4205.5b ofreference (a) states "When prisoners are no longer consideredto be suicide risks by a medical o f f i c e r , they s h a l l bereturned t o appropriate quarters", i n these cases, once themedical o f f i c e r ' s evaluation was provided to the b r i g s t a f f , 'steps should have been taken t o immediately remove him fromsuicide r i s k , to a status below that.Page 2 of 3ManningB_00011412885 of 1505^^Subj: SPECIAL INQUIRY INTOTHE ARTICLE 138 COMPLAINT SUBMITTEDON 19 JANUARY 2011 BY PRIVATE FIRST C^ASS BRADLEYMANNING,U.S. ARMY3.
