Your clearance is currently valid andyou just need to be read-on.Read-on's will likely occur in City. We acknowledge the rights of the accused under RCM 405(f). However, wewould l i k e t o highlight that there is no documented precedence that empowersthe defense to use the Article 32 investigation t o explore a l l possibletheories of mitigation and extenuation for matters that would only bepotentially relevant during the sentencing phase of the t r i a l , i f any. As youw i l l see in Garcia, the Court, in dicta, quotes Article 32 stating the"accused has the right to present anything he may desire in his own behalf[,]"but actually rules on the v a l i d i t y of an Article 32 waiver. The defense'sproffered testimony i s not relevant to the charged misconduct or anymitigation or extenuation evidence towards the alleged acts of the accused(IAW the charge sheet). The defense i s simply trying to use the Article 32 asa vehicle t o openly explore alleged failures of the chain of command which arenot relevant t o charges, thus outside the scope of RCM 405 and your charter.In fact, the defense uses the statement "each of these witnesses can providedifferent insight into the events that transpired between 1 November 2009 and27 May 2010[;]" however based on the defense's proffer, the "events" are notrelated t o alleged criminal acts of the accused, but the actions of others whointeracted with the accused.2. RCM 405(g)(1)(A) purposely limits witness production for witnesses thatare both relevant and not cumulative. Each witness the United States objectsto based on cumulative testimony, i s i n fact cumulative with others on thewitness l i s t . The purpose of the Article 32 i s to conduct a "thorough andimpartial investigation of a l l matters" and that can s t i l l be accomplished byreceiving testimony by multiple other witnesses with similar access toinformation, proximity t o the accused, or part of the same j o i n tinvestigation.3. As for any witnesses t e s t i f y i n g about alleged mental health issues, i tdoes not appear from the defense's proffered testimony that the defenseintends t o present testimony as to the accused's having partial mentalresponsibility for the alleged crimes; therefore these witnesses are notrelevant to the charges, including mitigation or extenuation on the merits.The United States responses are based solely on defense's proffered testimony.The United States does not argue with the defense that a diminished capacityamounting t o a partial mental responsibility defense could be relevant asmitigation and extenuation.4. The defense's witnesses who they proffer w i l l t e s t i f y about allegedArticles 13 and 37 violations are not relevant. Our analysis under #1 aboveapplies as well. Additionally, defense's proffered Articles 13 and 37FOR OFFICIAL USE ONLY02938076FOROFFICIALUSEONLYviolations are matters reserved for the convening authority p r i o r t o referraland ultimately a military judge at a court-martial, i f this case is referred.The substance of these matters and the fact they allegedly occurred afterthecommission of the alleged offenses make these witnesses not relevant to theaccused's alleged misconduct, thus outside the scope ofyour investigation.5. Thedefense misrepresents the government's position in Footnote 1. TheUnited States did not state in its responsethat itwould not entertaintravelfor defense witnesses based on their production being "too costly andtroublesome." The United States w i l l entertain the defense's request forwitnesses that are not relevant or cumulative and based on your determinationof availability and method of production, w i l l produce the witnesses.Additionally, the United States intends to request some of its witnesses becalled telephonically, rather than in person, but cannot make that requestuntil you make a determination on which witnesses you w i l l call as theinvestigating officer. As of today and absent the government's request tohave the senior ranking government officials declared not reasonablyavailable, the United States has not objected to the personal appearanceofany witnesses, boththe government's or defense's. The United States hasobjected to you considering certain witnesses based on relevance and/orcumulative production. However, the United States does intend to make futurerequests to have some witnesses testify telephi^ically to minimize costs,depending on which witnesses you ultimately order to be produced and arereasonably available.6. TheUnited States objects toyour consideration ofArticle 131, Perjury,as a reference in determining whether a statement is properly sworn. Article131 is a punitive article intended to criminalize sworn statements byServicemembers during a judicial proceeding. The original classificationauthority (OCA) reviews are simply sworn statements made "under penalty ofperjury" I^28US.C. 1746.
